The European Certificate of Succession is a document that proves your status as heir, legatee, administrator or executor of an estate in any European Union member state.
What is the European Certificate of Succession?
What the certificate is for
The European Certificate of Succession lets heirs, legatees, executors and administrators prove their status in any EU country without further procedures.
It is particularly useful when the deceased held assets in several member states.
Scope
It applies to successions with cross-border implications within the EU, except Denmark and Ireland.
It takes direct effect in all member states without any prior recognition.
Notarial competence
In Spain the European Certificate of Succession is issued by the notary with jurisdiction over the succession.
It is applied for on an official form and issued within a set period once the documents have been checked.
How long the certificate is valid
Certified copies are valid for 6 months from issue.
After that period a new certified copy can be requested.
Documents required
The deceased's documents
- Death certificate.
- Certificado de últimas voluntades, the Spanish register of last wills.
- Will or declaration of heirs.
- The deceased's DNI or passport.
The applicants' documents
- DNI, NIE or passport of the heirs applying.
- Libro de Familia, or birth and marriage certificates.
- The application form for the certificate, duly completed.
Documents on assets abroad
- Identification of the assets located in other member states.
- Documents proving ownership, such as title deeds and register extracts.
The notary's office may ask for further documents depending on the specifics of each case.
