Division into Units

Division into units (división horizontal) is the legal regime that allows a building to be divided into independent units (flats, commercial premises, garages, storage rooms) with private and common elements. It is essential in order to sell or mortgage each unit separately.

Title deed to the building

Title deed to the parent property, or the new building deed (obra nueva) if it is a recent construction.

Licence for division into units

Authorisation from the Town Hall or a declaration that no licence is required (declaración de innecesariedad), depending on local regulations.

Description of the units

Detailed list of each private unit: location, surface area, boundaries, appurtenances and ownership share.

Community bylaws

Internal rules of the community of owners (optional but recommended).

Building logbook (new buildings)

For newly built buildings, the building's technical documents in accordance with the applicable regulations.
